Winding Down or Terminating Cross-border Lease Transactions

The current credit crisis may have created an opportunity for equity investors to wind down or terminate the cross-border lease transactions that were entered into over the last 20 years. The IRS is currently scrutinizing these transactions, particularly the Lease In Lease Out’s, Sale In Lease Out’s and the Qualified Technological Equipment’s.

Joe Voyticky, of counsel with Pepper in the Financial Services Practice Group and a resident in our quickly expanding New York office, explains this issue and what equity investors should be doing today.

Housing Update Live

Recently, Pepper Hamilton partner Sheldon Schreiberg hosted a Housing Update conference which featured Kim Griffith, Vice President of Affordable Housing Lending and Investment at Freddie Mac. In this role he oversees Freddie Mac’s Affordable Multifamily Lending and Investment activities.

In today’s liquidity crisis, Freddie Mac, with its sister, Fannie Mae have reemerged as dominant multifamily lenders, replacing much of the conduit activity of the past few years. This podcast is a portion of Kim Griffith’s comments where he describes some of the marketplace conditions the Affordable Housing Industry is facing and how these condition are affecting Freddie Mac.

State of the Mortgage Markets - Dan Murray

Recently, Pepper Hamilton co-hosted a conference with Ernst and Young entitled “The State of the Mortgage Markets in 2008”. The conference focused on what the mortgage and capital market participants can expect next and what they might need to do if litigation occurs. This podcast features Dan Murray’s presentation.

Dan is a partner in Pepper Hamilton’s Princeton office and concentrates his practice on mortgage banking, consumer finance, banking and general corporate law. In his presentation, Dan focused on secondary market implications and likely litigation and other controversies for loan modifications under the American Securitization Forum and Treasury Plan.

High Cost Loans to Military Personnel

President Bush recently signed into law an amendment to the Miscellaneous Prohibitions and Penalties chapter of the General Military Law which prohibits creditors from entering into payday loan and title loan agreements with active duty service members.

Rick chairs Pepper’s Financial Services Practice Group and Albert is a Pepper partner and lieutenant colonel in the Judge Advocate General Corps of the U.S. Army Reserves.
